GENERAL TERMS AND CONDITIONS OF TRADE - EXHIBITION(Updated: December 2 2015)
The organiser of the event is about:design UG (haftungsbeschränkt) (hereafter about:design)

2. BOOKING AND ADMISSION
2.1 Admission to the event requires a fully completed online participation form in which the applicant legally acknowledges the terms and conditions. The submission of the form equals a mandatory booking.
2.2 Participants will be selected by the organizer, i.e. a board of trustees set up by the organizer. The applicant will be notified of the outcome via email.
2.3 In case of admission, a contract is established. The participant receives an invoice including payment instructions. The payment is to be executed within 7 working days upon the receipt of the invoice.
3. COSTS, CONDITIONS OF PAYMENT AND CANCELLATION
3.1 Prior to the selection of participants by about:design, no costs impend on the participant. Following reception of the admission and invoice, the exhibitor is required to pay his/her participation fees within seven days after reception of admission.
The receipt of the invoice concludes the contract and from that point on participation is mandatory.
In case of an outstanding balance after seven days, about:design reserves the right to invoice arrears of 5,00€ for the first arrears letter and 15,00€ for the second arrears letter.
If the participant still has not paid by the date indicated in the arrears letter, about:design can give away the space and any claim for participation is no longer effective.
The prices featured on the application form do not include the current VAT of 19%.
3.2 Reclamations regarding the invoice should be made in written within 14 days following reception. Further cancellation conditions prevail:
Cancellations that take place more than 6 weeks before the opening of the event will be billed with 50 % of the participation fee.
Cancellations that take place 6 to 4 weeks prior to the opening event will be billed with 75% of the participation fee.
Shot-term cancellations made less than 4 weeks before the beginning of the event will be billed with 100% of the participating fee...
3.3 All charges that arise by bank transfer to about:design has to be beared by the participant (for example international bank transfer charges).
4. EXHIBITION SPACE
about:design allots the exhibition spaces according to the announced participation projects, in due consideration of all related technical data and of the general exhibition concept. The participant is obliged to keep the exhibition space clean and prevent any damages.
5. CONSTRUCTION AND DISASSEMBLY, MAKEUP OF THE STAND
5.1 Construction and disassembly of the stands as well as deliveries are submitted to a strict schedule which the participants will receive together with the written participation confirmation. This schedule has to be strictly observed.
5.2 The stand must conform to current building regulations as well as to the technical guidelines of the organizer or the landlord. Conditions and building regulations for the various exhibition events are featured in the regulations pertaining to the event, which shall be sent to the participants after admission.
5.3 During construction and disassembly and during the entire duration of the event, all legal accident prevention regulations and other safety regulations have to be respected.
5.4 The organizer’s technical guidelines as well as information featured in the organizer’s newsletters regarding the preparation and implementation of the event have to be respected.
5.5 The organizer is responsible for safety regulations regarding stand safety and fire control. All tasks requiring the use of open flames, welding, cutting, soldering and melting have to be submitted to the organizer and can only be carried out with permission.
5.6 During the exhibition’s opening times, the stand has to be permanently occupied by personnel. The participant is personally responsible for the supervision of the stand during opening times and during the construction/disassembly. Therefore, each exhibitor is responsible for the security of his objects, especially in the case of theft.
5.7 Regarding stand construction, the tasks of the organizer are limited to the installation of electricity for the stand and the set-up of partition walls and ceiling suspensions that have been previously booked by the participant. Please note that additional materials such as multi sockets are not provided by the organizer.
5.8 Ceiling suspensions are not possible or only conditionally possible. Ceiling suspensions need to be arranged separately with the organizer. Depending on the position of the booth, the ceiling height can vary.
5.9 The floor of the exhibition venue can be neither painted nor drilled. Adhesive tape has to be removed with all of its residue. Drilling into the concrete-wall is not allowed.
5.10 The exhibitor is under obligation to exhibit the projects and/or objects that were named and described in the application form and that have been accepted by about:design. The exhibitor is bound by contract to use the exhibition space only to the specific agreed purposes. He/She is not allowed to sublet the booth.
5.11 The concept of the exhibition as a whole is the responsibility of the organizer.
5.12 The exhibition spaces for the modules „Lab“ and „Educationr“ will not be allocated uniformly. Depending on the project, about:design will allocate areas according to capacities, repertoire and the individual needs of the participant. The organisation and architecture of the exhibition space is subject to about:design.
5.13 It is strictly forbidden to disassemble the exhibition space before the end of the exhibition. Disassembly of the stand is allowed only after the end of the exhibition. About:design is entitled to compensation claims should this not be respected.
5.14 The participant is liable for damages to the exhibition space, which has been caused by the exhibitor, his staff and third parties after the move in. Damages to the exhibition space have to be reported to the organizer immediately.
6. WEBSITE, MEDIA AND PRESS
6.1 The festival participants will be featured with texts and images on the DMY 2015 website. In order to adequately feature the participants, information and images have to be submitted on time. Deadlines will be sent to applicants after admission. If the material is sent in late, about:design reserves the right to resort to information contained in the application or to similar texts from previous events. About:design assumes no responsibility for the accuracy of the information.
6.2 In submitting his/her application, the participant agrees to the publication and the unlimited use of the material submitted to about:design on the occasion of the exhibition for the use of promotion, press, documentation and presentation material. About:design entitles itself to textual alterations in the participants’ entry on the website and in other media. Participants must ensure that the material does not violate the rights of third parties (copyrights/ image rights).
6.3 In submitting his/her application, the participant agrees to the publication and the unlimited use of the material submitted to about:design on the occasion of the exhibition for the use of promotion, press, documentation and presentation material. About:design entitles itself to textual alterations in the participants’ entry in the exhibition catalogue and in other media, e.g. the DMY 2015 Website. Participants must ensure that the material does not violate the rights of third parties (copyrights/ image rights).
6.4 The copyright on the submitted objects remains with the participants in question.
The sale of goods, products, samples, food and drinks at the stands within the central exhibition (Showroom, Lab, Education) is prohibited. However, the exhibitor is allowed to sell their products in the dedicated area within the store area.
In case of infringement of the above, a fine of 2,000.00€ is incurred by the participant.
For sale of design objects within the store area the general festival rules apply. Exhibitors are responsible for the handling of their respective trade tax payments.
about:design declines all responsibility regarding risks related to the exhibition, in particular the loss or damage of objects, or injuries by third parties. We recommend exhibitors to take out an adequate insurance.
The participant is the organizer of the submitted project and must therefore fulfill his/her duties appropriately and conscientiously; in particular, the participant must release about:design from all liability for civil offense regarding third parties. About:design´s liability is limited to willful intent and gross negligence.
10. WASTE AND DAMAGE COSTS
The participant has to take over the waste disposal. Costs incurred by left waste or damage of the exhibition space, especially of the floor and the building surfaces, have to beard by the participant responsible for the damage. If the perpetrator cannot be identified, about:design UG (haftungsbeschränkt) is entitled to burden several likely perpetrators with the expenses caused by the damage. The exhibition space has to be handed back well-swept.
11. PLACE OF FULFILMENT, PLACE OF JURISDICTION
Place of fulfilment and jurisdiction is Berlin. German law applies exclusively.
In case of cancellation due to force majeure, the parties are released from their contractual obligation. About:design’s expenditures that have incurred until this point have to be paid in accordance with the conditions stated in No. 3 (2)
